Copyright notice and Terms of Use 

Summary

Unless explicitly mentioned otherwise, Estate of Ivan Massar owns the exclusive copyright to all photographs and text appearing on www.ivanmassar.com. All images are registered with the US Copyright office. No images are within the Public Domain. Any use of images outside of the guidelines outlined in this document is copyright infringement.

  1. Sample, design, test, or layout use ("comp use") of watermarked images can be done without permission.  All other uses require written permission obtained through email. 
  2. Usage fees may be reduced or waived for non-commercial purposes, but approval is required. Free permissions always require proper attribution (including an active backlink, if used online), and no alterations. 
  3. All others will require a license agreement and payment.

A. Image uses that require a license 

Any commercial use. This includes, but is not limited to:

  • use on behalf of any organization which has paid personnel (INCLUDING NON-PROFIT, educational, religious, or governmental organizations), 
  • use in your professional work (for example internal presentations, newsletters, logos, stationery, cards, and teaching materials), 
  • use for advertising, editorial or promotional purposes (including any fundraising activities and auctions), 
  • use on a commercial, advertising, or self-promotional web site, 
  • use on a product that is sold, or contains paid advertising. 

The only exceptions are sample, design, test, or layout use ("comp use") for the purpose of evaluating how a finished piece will look. If you have particular concerns about image use, or wish to reproduce any of the images for professional or commercial purposes, please contact Massar Studios LLC at massarstudios@gmail.com. 

B. Image uses that do not require a commercial license 

1. PUBLIC USE (diffusion) for personal, non-commercial purpose requires permission

You must contact Massar Studios LLC for authorization with the following information:  ID numbers of the image(s) you wish to use, the details of your project, and the address of your finished web page.

Permission may be granted for free for the following types of reproduction:

  • inclusion in the creation of derivative works such as paintings and drawing for personal or educational use
  • limited diffusion in personal educational documents such as school reports and thesis (for student only). 
  • display on a personal non-commercial web page (this excludes self-promotional web pages) provided that you display next to the image: (a) copyright information and (b) an active HTML link to www.ivanmassar.com. A code like the following is appropriate:

2.  PUBLIC USE (diffusion) for all-volunteer organizations requires permission

If you are a all-volunteer organization with no paid staff or membership fee, and you provide only free services or information, you may qualify to use free image for:

  • the organization's brochure, newsletter or slide/PowerPoint presentation. 
  • Display on the organization's website, provided that you display next to the image: (a) copyright information and (b) an active link to www.ivanmassar.com. A code like the following is appropriate:

Image use by all-volunteer organizations requires written authorization. For consideration, email massarstudios.com with the following information: (a) name, full address, and background of the organization, (b) intended use of the image(s), (c) address of the non-profit web site (if any). 

General conditions for free image use

Attribution. No free images or text may be used without carrying appropriate copyright information next to the images or text.

No Alterations. All free images must accurately represent the original work and be used in their entirety. Tampering, additions, cropping, low quality reproduction, or other alterations and transformations that would affect the integrity of the image are not permitted. This include removal of the "© Ivan Massar" mark. 

Rights. The images or text from ivanmassar.com that you obtain from any source are licensed to you by the Estate Ivan Massar for the limited purpose of personal, private use. In case of public use, any grant of rights is only for the specific use for which you were granted permission. Any other subsequent use requires a separate authorization. Further, no license is granted in respect of any property rights.   The Estate of Ivan Massar retains full and complete title to the images or text, and any intellectual property rights therein. 

Massar Studios LLC and ivanmassar.com reserve the right to make future changes to these guidelines. By using any Ivan Massar image you thereby consent to these guidelines and any future changes. 

C. General terms of use of this web site 

Links 

You are always encouraged to make a link to any of the web pages included on this server without any restriction.

Prohibited actions 

  • embedding images into a web page
  • using programs to automatically download or spider large portions of the ivanmassar.com site for purposes other than indexing. 
  • framing of any of the ivanmassar.com web pages.
